What Is a Personal Injury Lawyer, Exactly?

In Georgia, a person who suffers harm (called a “plaintiff”) and sustains certain types of losses (financial, physical, emotional, etc) can generally seek compensation from the at-fault party to recoup those losses. How Does the Claims Process Work in Fulton County?

If you want to work with our Atlanta personal injury lawyers, the first thing we’ll do is schedule your free initial consultation so we can hear more about what happened. This meeting is about more than just gathering information, though; it’s about giving us all a chance to get to know each other. We may be spending a lot of time together, and it’s important to us that you feel comfortable and safe in our care. 

If we believe you have a case, we’ll give you a contract to sign (more on that later), and that will mean you have officially retained our firm. Then, we can start our fact-finding process by requesting any evidence there is: photos, video footage, medical records, police reports, etc. 

After we have reviewed your case, we can begin to build the demand letter. This is our request on your behalf for damages. We cannot make this demand until we know the full extent of your injuries, and see what kind of medical treatments you’ll need – and for long. We may also call upon our network of experts to help reconstruct the scene of the accident, analyze your financial burden (current and future), and assess your medical condition. 

We will send this letter to the liable party – generally, the insurance company – and then we negotiate. This is a given, because even with our reputation as trial attorneys, most insurance companies won’t simply agree to our terms off the bat. Then, one of two things happens:

  1. The negotiations are successful and we reach a settlement. That settlement is then deposited into a trust, and any outstanding bills and liens are paid. The remainder goes to you.
  2. The negotiations fail, and we proceed to trial. A success at trial ultimately ends the same way: the award you’ve won is deposited into a trust, all bills are paid, and then you receive the remainder.

Do I Have to Go to Trial?

No – you don’t HAVE to go to trial. 

We understand that the idea of going to trial can be frightening. When you’re out of work and in pain and worried about your future, it’s pretty tempting to say yes to a smaller settlement than to roll the dice on a potentially much larger verdict. 

What we want you to understand, however, is that once you accept a settlement, that’s the end: you cannot seek more money later, even if you discover that your injuries are more severe. You cannot reopen a claim or file a new one for the same accident. 

The Dixon Firm will never force you into a jury trial, but we will advise you if we think it’s the only way you’ll get a fair award. We lay out your options so you can make the best decision for you and your family. And if that option is going to trial, you can expect the same level of care, compassion, and communication with us throughout the process. 

How Soon Will I Receive My Money?

If everything goes to plan, it can be as little as two weeks. If you have a lot of outstanding bills, called liens, that must be paid first, it can take a little longer. 

What Are the Most Common Causes of Injuries in Georgia?

Most injuries are the result of poor decisions – either our own, or someone else’s. But a great many injuries are caused by factors entirely outside of our control, such as weather patterns. Based on the people we’ve helped over the years, the leading causes of injury in Georgia include:

  • Motor vehicle accidents.

    Car, truck, and motorcycle accidents are absolutely leading causes of injury. The Georgia Department of Public Health says they were also the second-leading cause of death in our state. 

  • Dangerous properties.

    When you are injured on someone else’s property, that owner or operator may be held liable for your losses through a premises liability claim. Examples include:

      • Falls, which are THE leading cause of injury and death for two distinct groups: the elderly, and workers. 
      • Dog bites, which primarily injure small children.
      • Deck collapses, regardless of whether they’re public or private property.
  • Medical Negligence.

    There are risks to modern medicine, and a bad outcome doesn’t necessarily mean your provider was negligent. However, if your or a loved one suffered undue harm because of a medical error or a dangerous policy, we want to help you. 

  • Dangerous products.

    Companies owe their customers a duty of care. When they make faulty products, skimp on quality control, or outright lie to the public about a product’s safety, it puts us all at risk. If you suffered harm, you can claim compensation through a product liability claim or lawsuit. 

  • Dangerous worksites.

    Injured workers in Atlanta may be able to file a workers’ compensation claim as well as a third-party injury claim, depending on the circumstances. Ineligible workers (like contractors), site visitors, passers-by, and other folks would have to file a personal injury claim, as they could not file for workers’ comp.

How Long Do I Have to File a Personal Injury Claim in Atlanta?

You have two years to file a personal injury claim in Atlanta. This statute of limitations has some exceptions. Minor children may have longer. Plaintiffs suing a government agency have much less time to file.

Does It Matter If I’m Also at Fault?

In Georgia, you can file a claim even if you share partial responsibility. We follow a modified rule of comparative negligence. That means you can be found up to 49% at-fault for your own injuries (or for the events which led to them) and still make a claim. However, your total award will be reduced by your percentage of fault. So if you are awarded $100,000 but found to be 20% at fault, then you would only receive $80,000.

How Much Does an Atlanta Personal Injury Attorney Cost?

  • You don’t pay any fees or costs upfront, including the costs associated with consultations, depositions, trial prep (if necessary), and so forth.
  • You don’t pay anything at all if we don’t win – not fees, not associated costs, nothing. 
  • Once we reach a verdict or settlement, we take our fee from your total award. That’s why we say you never put your hand in your wallet for anything. 

Attorney fees vary by firm. The Dixon Firm charges depending on the complexity of the case, with fees ranging from 25% to 45%, but that’s not money you ever have to pay out of pocket.

How Long Will My Personal Injury Case Take?

There’s no set answer here, because every case is different. One of the most important factors in an injury case is how long it takes for you to reach your maximum medical improvement (MMI), which is the point where you are unlikely to improve any more than you have, even with further treatment. In some cases, MMI only takes a few weeks or even months; think about how long it generally takes to heal from, say, a broken arm. But some cases, such as those involving organ damage or TBI, reaching MMI can take much, much longer. 

Other causes for potential delays include:

  • Disputes over liability by either the at-fault parties or the insurance company
  • Scheduling backlogs by the judges, lawyers, or other parties
  • Insurance companies dragging their feet
